SAN JOSE — A panel of appellate court justices heard arguments Monday on whether Santa Clara County District Attorney Jeff Rosen and his office should be booted from the explosive pay-to-play concealed-gun permit case ensnaring the sheriff’s office, because of Rosen’s past relationship with a defendant.

The justices’ ruling on the issue could upend prosecution of one of the biggest corruption scandals in the county’s history. Defense attorneys have spent the past few months assailing the credibility of indictments alleging that two of Sheriff Laurie Smith’s most trusted commanders schemed with her supporters to leverage concealed-carry weapons permits for political donations and favors.
